using RamBhumi

1 Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and RamBhumi Technologies Pvt. Ltd. ("RamBhumi", "we", "our", "us") governing your access to and use of the RamBhumi website, mobile applications, and related services (collectively, the "Platform").

By registering an account, browsing listings, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Platform.

2 Definitions

• "Platform" means the RamBhumi website, mobile applications, and all related services.
• "User" means any individual or entity accessing the Platform, including Buyers, Sellers, and Brokers.
• "Buyer" means a User looking to purchase or rent a property.
• "Seller" means an owner listing their own property for sale or rent.
• "Broker" means a real estate professional listing properties on behalf of owners or clients.
• "Listing" means a property or project published on the Platform.
• "KYC" means Know Your Customer verification, including PAN verification via Cashfree.
• "Content" means text, images, videos, data, and other materials uploaded to the Platform.

3 Eligibility

To use the Platform, you must:

• Be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872.
• Not be barred from using the Platform under any applicable law.
• Provide accurate, current, and complete information during registration and KYC.
• Comply with all applicable local, state, national, and international laws.

We reserve the right to refuse service, terminate accounts, or cancel listings at our sole discretion if eligibility requirements are not met.

4 Account Registration & Security

4.1 Account Creation

You must create an account to access certain features (listing properties, contacting owners, saving favorites). You agree to provide accurate information and keep it updated.

4.2 Account Security

• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorized access or security breach.
• You are liable for all activity that occurs under your account.

4.3 One Account Per User

You may not create multiple accounts to circumvent restrictions, evade KYC, or engage in fraudulent activity. We reserve the right to merge or terminate duplicate accounts.

5 KYC & PAN Verification (Cashfree)

5.1 PAN Verification Requirement

As part of KYC, you must submit your PAN number and name for verification. We use Cashfree Payments' PAN Verification API to validate your PAN against Income Tax Department records. By submitting your PAN, you explicitly consent to this verification.

5.2 What the Verification Returns

Cashfree's API returns the following information to us:

• PAN validity (valid or invalid)
• Name registered against the PAN
• PAN type (Individual or Business)
• Name match score (Direct Match, Partial Match, etc.)
• PAN status (Active, Deactivated, Fake, Deleted, etc.)

5.3 Your Obligations

• You must submit your own PAN. Impersonation or submitting another person's PAN is strictly prohibited and may result in account termination and legal action.
• You must ensure the name on your PAN matches the name on your RamBhumi account.
• You are responsible for updating your KYC if your PAN details change.

5.4 Consequences of Failed KYC

If your PAN verification fails, or if the name match score is insufficient, you will not be able to access KYC-restricted features. Repeated failures may result in account suspension.

5.5 Data Handling

Your PAN and verification result are handled in accordance with our Privacy Policy. We do not store your PAN with Cashfree beyond the API call duration, and we retain verification results only as required by law.

6 Platform Use & Conduct

6.1 Permitted Use

You may use the Platform for lawful purposes related to real estate — browsing, listing, enquiring, and transacting.

6.2 Prohibited Conduct

You agree NOT to:

• Post false, misleading, or fraudulent listings.
• Impersonate another person or entity.
• Upload content that is unlawful, obscene, defamatory, or infringing.
• Use bots, scrapers, or automated tools to access the Platform.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Harass, threaten, or abuse other users.
• Circumvent KYC requirements or verification processes.
• Engage in money laundering, fraud, or illegal activities.
• Violate any applicable law or regulation.

6.3 Consequences

Violation of these rules may result in immediate account suspension, content removal, and/or legal action.

7 Property Listings

7.1 Seller/Broker Responsibilities

• You must own the property or have explicit authorization to list it.
• All information (price, area, location, amenities) must be accurate and complete.
• You must have rights to all images and content you upload.
• You must disclose any material facts (encumbrances, legal disputes, etc.).
• You must comply with RERA (Real Estate Regulation and Development Act, 2016) where applicable.

7.2 Listing Moderation

We reserve the right to review, edit, reject, or remove any listing that violates these Terms or applicable law, without prior notice.

7.3 No Guarantee

We do not verify every listing's accuracy or legality and are not responsible for disputes between users. Buyers must perform their own due diligence.

8 Transactions & Payments

8.1 Nature of Platform

RamBhumi is a discovery and connection platform. We do not buy, sell, or rent properties ourselves. We do not act as an agent, broker, or intermediary in any transaction. All transactions are directly between Buyers, Sellers, and Brokers.

8.2 Payments

• Payments for premium services (featured listings, promotions) are processed through secure third-party gateways.
• All payments are subject to the payment gateway's terms and conditions.
• Fees are non-refundable unless otherwise stated.

8.3 No Transaction Guarantee

We do not guarantee the completion of any property transaction and are not liable for any loss arising from a failed or disputed deal.

9 Intellectual Property

9.1 Our Content

The Platform, including its design, logo, text, software, and graphics, is owned by RamBhumi and protected by Indian and international intellectual property laws.

9.2 Your Content

You retain ownership of content you upload (property photos, descriptions). By uploading, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for operating and promoting the Platform.

9.3 Restrictions

You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

10 Third-Party Services

The Platform integrates with third-party services including:

• Cashfree Payments — for PAN verification and payment processing.
• Cloud & hosting providers — for infrastructure.
• Communication services — for email, SMS, and notifications.
• Maps providers — for location display.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, secure, or error-free.
• Listings or user content will be accurate, complete, or reliable.
• Defects will be corrected.
• Any transaction will result in a successful deal.

12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAMBHUMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE PRECEDING TWELVE MONTHS, OR INR 5,000, WHICHEVER IS HIGHER.

13 Indemnification

You agree to indemnify, defend, and hold harmless RamBhumi, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Content you upload or share.
• Any transaction you engage in with another User.

14 Termination

14.1 By You

You may close your account at any time by contacting us. Certain data (KYC records, transaction history) may be retained as required by law.

14.2 By Us

We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent activity, or for any other legitimate reason. Upon termination, your right to use the Platform ceases immediately.

15 Governing Law & Disputes

15.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

15.2 Dispute Resolution

• Amicable Resolution: Parties shall first attempt to resolve disputes amicably through good-faith negotiations.
• Arbitration: If unresolved within 30 days, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.
• Seat: Arbitration shall be held in New Delhi, India, in English.
• Jurisdiction: Subject to arbitration, courts in New Delhi shall have exclusive jurisdiction.

16 Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or a prominent notice on the Platform. Your continued use of RamBhumi after changes are posted constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically.
